COLLABORATION AGREEMENT
This Agreement governs the relationship between BRANDBRIEF™ and any client ("Sponsor") who commissions a Sponsored Weekly Brief Challenge on the platform. By completing payment and confirming your booking, you agree to all terms set out below.
A Sponsored Weekly Brief is a BRANDBRIEF™ Weekly Brief Challenge created around the Sponsor’s brand, product, or creative concept. The brief is published to the BRANDBRIEF™ Instagram community and distributed across the platform’s channels for a period of seven (7) days (“Challenge Period”). Designers participate voluntarily and submit their work before the Challenge Period ends. Following the close of the Challenge Period, the Sponsor is presented with all public submissions and may choose — entirely at their own discretion — to engage one or more participating designers for further brand work. This post-challenge connection is a natural benefit of the Sponsored Brief format; it does not constitute a staffing or recruitment service, and BRANDBRIEF™ makes no guarantee that any specific designer will be available for further engagement.
BRANDBRIEF™ agrees to:
- Create a professional brand design brief incorporating the Sponsor's provided brand information, creative direction, and product imagery
- Publish the brief on the BRANDBRIEF™ Instagram feed and relevant platform channels on the agreed publication date
- Include the Sponsor's defined deliverables, constraints, and CTA in the published brief
- Manage the challenge posting, hashtag setup, and designer-facing communication
The Sponsor agrees to:
- Provide all required brand materials (product images, brand name, concept direction) within the agreed timeline prior to publication
- Review and approve the draft brief before publication (one round of revisions included)
- Confirm publication approval in writing (email or message) before the go-live date
- Complete payment in full via the designated Merchant of Record platform before publication
All payments are processed through BRANDBRIEF™'s designated Merchant of Record platform (currently Lemon Squeezy, Gumroad, or Polar.sh). Invoicing and VAT are handled by the respective platform. Payment must be received in full before the brief is published.
The Sponsored Brief fee covers exclusively the work performed by BRANDBRIEF™: brief development, creative research, copywriting, coordination, scheduling, and publication management. This fee does not constitute compensation for participating designers and will not be passed on to them in any form.
If the Sponsor wishes to engage a designer for further brand work following the challenge, any compensation, fee, or budget for that work is a separate arrangement negotiated directly between the Sponsor and the designer. BRANDBRIEF™ strongly recommends that Sponsors define and communicate a realistic budget for follow-up design work within the brief itself — this directly influences the quality and quantity of designer participation.
All payments for Sponsored Briefs are non-refundable from the moment of booking. By completing payment, the Sponsor acknowledges that work begins immediately and that no refund will be issued under any circumstances — whether the brief is in preparation, has been published, or for any reason does not proceed to publication.
This policy applies regardless of:
- The number of designer submissions received
- The quality or suitability of submissions for the Sponsor's needs
- The Sponsor's satisfaction with the creative outcome
- Competitive activity, platform algorithm changes, or external market conditions
- Any decision by the Sponsor to withdraw from the process after payment
By confirming booking and payment, the Sponsor explicitly acknowledges and accepts this no-refund policy in full.
BRANDBRIEF™ explicitly does not guarantee any specific level of designer participation in a Sponsored Brief. The following factors — among others — may influence participation volume and are entirely outside BRANDBRIEF™'s control:
- Simultaneous competing briefs on BRANDBRIEF™ or other platforms that attract community attention
- The relative appeal or perceived prestige of the Sponsor's brand, industry, or project scope
- The attractiveness of the offered budget or compensation for final design work
- Seasonal community activity levels (holidays, event periods, etc.)
- Subject matter difficulty or niche appeal of the design challenge
- Instagram algorithm reach and organic distribution at time of publication
BRANDBRIEF™ is a creative community platform, not a staffing or design agency. Designer participation is voluntary and self-directed. No minimum submission count is guaranteed or implied.
All design work submitted by participating designers in response to a Sponsored Brief remains the intellectual property of the respective designer unless a separate agreement is made directly between the Sponsor and the designer. BRANDBRIEF™ facilitates the challenge but is not a party to any IP transfer between Sponsor and designer.
If the Sponsor wishes to purchase, license, or acquire rights to a specific designer’s submission, that negotiation occurs directly between the Sponsor and the designer. BRANDBRIEF™ may facilitate introductions but assumes no responsibility for the outcome of those negotiations.
One of the core benefits of a Sponsored Brief is the opportunity to discover and directly connect with designers whose aesthetic and thinking aligns with the Sponsor’s brand. At the close of the Challenge Period, BRANDBRIEF™ will provide the Sponsor with an overview of public submissions and, where applicable, facilitate an introduction to designers the Sponsor wishes to consider for further work.
Any subsequent engagement between the Sponsor and a designer — including paid brand design work, retainers, or licensing — is a private arrangement negotiated directly between the parties. BRANDBRIEF™ is not a party to such agreements and accepts no liability for their outcome. Designers are independent creatives and cannot be compelled to accept any engagement. Similarly, BRANDBRIEF™ does not require Sponsors to hire a designer as a condition of the Sponsored Brief arrangement.
BRANDBRIEF™ strongly encourages Sponsors to approach the challenge with a genuine intent to develop their brand and to consider the participating designers seriously. Sponsors who book with a concrete budget for follow-up design work — and communicate this clearly in the brief — consistently attract higher-quality and higher-quantity submissions.
The Sponsor grants BRANDBRIEF™ a non-exclusive, royalty-free license to use provided brand materials (images, name, concept) solely for the purpose of creating and publishing the Sponsored Brief. This license terminates after the challenge period ends. BRANDBRIEF™ may archive or reference the brief for portfolio or press purposes.
BRANDBRIEF™ will exercise reasonable care in creating the Sponsored Brief based on materials provided by the Sponsor. However, BRANDBRIEF™ is not liable for any inaccuracies arising from incomplete, incorrect, or misleading information supplied by the Sponsor.
Booking a Sponsored Brief requires careful consideration before purchase. We encourage every prospective Sponsor to review this Agreement in full and confirm their intent before completing payment.
Work on the Sponsored Brief begins immediately upon receipt of payment — regardless of whether the brief is ultimately published. This includes, but is not limited to, brief development, creative research, copywriting, coordination, scheduling, publication management. The payment therefore covers this effort in full.
No refunds will be issued at any stage — whether before, during, or after publication.
For Sponsors based in the European Union: by completing payment, you expressly request that BRANDBRIEF™ begin performing the service immediately and acknowledge that you thereby waive your right of withdrawal under applicable EU consumer law (Directive 2011/83/EU, Art. 16(a)), to the extent permitted by law.
BRANDBRIEF™'s total liability under this Agreement shall not exceed the amount paid by the Sponsor for the specific Sponsored Brief in question. BRANDBRIEF™ is not liable for indirect, consequential, or reputational damages arising from the challenge outcome.
This Agreement is governed by Austrian law. Disputes shall be resolved in the competent courts of Vienna, Austria.
By completing payment for a Sponsored Brief, the Sponsor confirms they have read, understood, and agreed to all terms of this Agreement.
